West Virginia mom charged with neglect in baby's death

BENWOOD, W.Va. (AP) — A mother was charged with child neglect resulting in death after her months old baby died from injuries sustained while the woman was allegedly using drugs at a West Virginia home, according to authorities.

Kace Lee Shmigal, 31, surrendered to authorities on the charge Thursday, news outlets reported.

Benwood police began investigating July 11 after the infant, who was born in April, was transported to an emergency room from a Benwood home, The Intelligencer reported, citing police documents. The child was airlifted to a Pittsburgh hospital, where she died of her injuries Wednesday.

Doctors determined the infant had ligament damage to her neck and possible damage to her brain.

Shmigal allegedly told police that she was napping with the baby and she may have "accidentally" struck the child while sleeping, according to police reports obtained by the newspaper.

The homeowner gave police security video allegedly showing evidence of Shmigal using drugs, police said. The homeowner also told investigators she sold Shmigal a prescription opiate.

Shmigal was jailed on a $100,000 bond with a hearing set for Aug. 7.

It was unclear whether she had an attorney who could comment on her behalf.
