ELK GARDEN - An Elk Garden man remains jailed after being arrested Feb. 8 following a verbal altercation involving a firearm.
According to the West Virginia State Police, 24-year-old Dakota Daugherty was arrested in Elk Garden when members of the Keyser Detachment responded to the area after being notified that he had had a verbal altercation and had discharged a firearm while at the residence. 
Upon the first unit’s arrival, Daugherty had already left the residence with the firearm. Secondary units patrolled for the suspect vehicle and later located  him in Elk Garden. 
Upon speaking with the family, officers learned the verbal altercation occurred with his mother while his 14-year-old sister was present. Daugherty was reported to have destroyed property within the residence before loading a firearm, which he then discharged from the porch, allegedly into the yard. He then fled the residence.  
Daugherty was arrested for two counts of domestic assault second offense, being a prohibited person in possession of a firearm, possession of stolen property (firearm), and discharging a firearm within 500 feet of a dwelling.
He was incarcerated at the Potomac Highlands Regional Jail in Augusta in lieu of $6,000 bond.
The recovered firearm is a subject of another investigation also under the jurisdiction of the WV State Police Detachment. Criminal charges are pending the completion of that investigation.
